Terms and Conditions - TROJAN AUTOS LIMITED
1. Definitions
"The Company" refers to TROJAN AUTOS LIMITED, and its employees or agents.
"The Customer" refers to any individual, firm, or company contracting with The Company.
"The Vehicle" refers to the vehicle detailed on the job card or estimate.
"The Work" refers to the repair, servicing, or other work carried out by The Company on The Vehicle.
"Estimate" refers to the written quotation provided by The Company for The Work.
"Invoice" refers to the final document detailing the completed work and associated costs.
2. Estimates and Quotations
Estimates are based on initial inspections and are subject to change if further work is required or unforeseen damage is discovered during The Work.
Any additional work required will be communicated to The Customer for approval before proceeding.
Estimates are valid for [Number] days from the date of issue.
All prices quoted are inclusive/exclusive of VAT as stated.
3. Payment
Payment is due upon completion of The Work and before The Vehicle is released to The Customer.
Payment can be made by [List accepted payment methods, e.g., cash, credit/debit card, bank transfer].
The Company reserves the right to retain The Vehicle until full payment is received.
Late payments may incur interest at [Percentage]% per month or part thereof.
If the vehicle is left for over 30 days after the work has been completed and payment has been requested, storage charges may be applied at a rate of £[Amount] per day.
4. Workmanship and Warranty
The Company warrants that The Work will be carried out with reasonable skill and care.
The Company provides a warranty of [Number] months/years on workmanship and materials, subject to fair wear and tear. This warranty excludes rust repairs, and any damage caused by neglect, misuse, or accident.
Warranty claims must be made within the warranty period and supported by the original invoice.
The Company's liability under the warranty is limited to the cost of rectifying the defective work.
Parts supplied by the customer are not covered by any warranty provided by the company.
5. Customer Responsibilities
The Customer is responsible for ensuring that The Vehicle is insured while in The Company's possession.
The Customer is responsible for removing any personal belongings from The Vehicle before The Work commences.
The Customer must provide accurate and complete information about The Vehicle and any existing damage.
The Customer must provide the vehicle's V5C document if asked for, to verify ownership.
6. Liability
The Company shall not be liable for any loss or damage to personal belongings left in The Vehicle.
The Company shall not be liable for any indirect or consequential loss or damage arising from The Work.
The Company's liability for any direct loss or damage shall be limited to the cost of The Work.
The Company shall not be liable for delays caused by factors outside of our control, including but not limited to, part delays, or supplier issues.
7. Storage
The Company reserves the right to charge storage fees for The Vehicle if it is not collected within [Number] days of completion of The Work.
The Company shall not be liable for any damage to The Vehicle while in storage, unless caused by The Company's negligence.
8. Right to Lien
The Company has a right to lien on The Vehicle until all outstanding invoices are paid in full.
9. Data Protection
The Company will collect and process personal data in accordance with the Data Protection Act 2018 and the UK General Data Protection Regulation (UK GDPR).1
Customer information will only be used for the purpose of completing the requested work, and for communicating with the customer regarding that work.
10. Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales.2
Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts3 of England and Wales.
11. Amendments
The Company reserves the right to amend these terms and conditions at any time.4
